Terms of use
These terms cover the TCG Tracker AU app and this website. By using either, you agree to them. They are written in plain English. If something is unclear, email support@tcgtrackerapp.com.
1. Who we are
TCG Tracker AU is run by Cameron Koorengevel, a sole trader in Queensland, Australia, ABN 92 861 674 264 ("we", "us").
2. What the app does, and doesn't do
The app tells you when trading card products appear, restock or open for pre-order at Australian retailers, and shows store stock where retailers make it available. That information comes from the retailers' own websites. It can be late, incomplete or wrong, and stock can sell out before you get there.
We don't sell anything in the app except optional Pro membership and tips. When you buy a product, you buy it from the retailer, under the retailer's terms.
3. Your account
- You need to be 13 or older to use the app.
- Use an email address you can access, and keep your password to yourself.
- One person per account.
4. Fair use
Please don't abuse or threaten other people, interfere with the app or our servers, copy or resell our alerts or data in bulk, or try to game competitions with extra accounts. We may suspend or remove an account that does, as described in the privacy policy.
5. Pro and tips
Pro is an optional subscription and tips are optional one-off payments. Google Play or the App Store handles the payment, renewal and cancellation, under their terms. You can cancel Pro at any time in your app store's subscription settings; it stays active until the end of the period you paid for. Refunds are handled by Google or Apple under their policies.
We may change what Pro includes over time. If a change takes something significant away, we'll tell you in the app first.
6. Ads
The free version shows ads served by Google AdMob, including optional rewarded ads for Potions and store checker passes. The privacy policy explains what that involves.
7. Competitions
Competitions run under the separate competition terms.
8. Affiliate links
Some retailer links may be affiliate links. If you buy after tapping one, the retailer may pay us a small commission at no cost to you. It never changes which products we alert you about, which retailer we send you to, or how fast the alert reaches you.
9. Names, logos and content
The app, this website and their design belong to us. Product names, images and trademarks belong to their owners and appear only to tell you what is in stock. We are not affiliated with, endorsed by, or connected to Nintendo, Creatures Inc., Game Freak, The Pokémon Company, Bandai, Wizards of the Coast, or any retailer.
10. Australian Consumer Law
Nothing in these terms limits rights you have under the Australian Consumer Law that can't be excluded. Apart from those rights, the app is provided as it is. We work hard to send every alert quickly, but we aren't responsible for a missed drop, a sold-out product, or a retailer's mistake, and to the extent the law allows, our liability is limited to supplying the service again or refunding what you paid us in the past 12 months.
11. Changes
When these terms change, the date at the top changes with it. Significant changes are announced in the app.
12. Governing law
These terms are governed by the laws of Queensland, Australia.
